Terms of use

Effective August 25, 2026

These terms govern your use of subconscious.ai, our documentation, Market View, public leaderboard, newsletter, and any demo or trial environment we provide together, the Site. By using the Site you accept them. If you do not, do not use the Site.

A signed order form, master agreement, or data partnership agreement governs your use of our platform and controls wherever it conflicts with these terms.

Company

Subconscious AI, Inc. is a Delaware corporation at 108 Lakeland Avenue, Dover, DE 19901.

Who may use the Site

You must be at least 16 and able to form a binding contract. If you use the Site for an organization, you confirm you are authorized to accept these terms for it. We may refuse or withdraw access to anyone, at any time.

What you may do

We grant you a limited, revocable, non-exclusive, non-transferable license to view and use the Site for your own evaluation and internal business purposes. Everything on the Site, including our software, models, methodology, research, and content, stays ours.

What you may not do

Do not reverse engineer, decompile, or attempt to extract our models, weights, prompts, or methodology. Do not scrape, crawl, or bulk download the Site or use it to train, fine-tune, distill, or evaluate any model. Do not resell or redistribute anything from the Site. Do not probe, disrupt, or circumvent our security or rate limits. Do not upload anything unlawful, infringing, malicious, personal, confidential, or regulated to a demo or trial environment. Do not use the Site to build a competing product.

Our Acceptable use policy also applies and is part of these terms.

Simulation output

Our platform and demos produce probabilistic estimates of human decision-making. They are simulations, not observations of real people, and not responses collected from real respondents. Any accuracy figure we publish describes performance against a stated validation set under stated conditions. It is not a warranty or a prediction of accuracy for your question, category, or population.

You are responsible for human review before acting. Do not present output as if it came from real respondents. Do not use it as the sole or principal basis for a decision with a legal or similarly significant effect on a person, including credit, insurance, employment, housing, education, healthcare, or government benefits.

Your content

If you upload anything to the Site or a demo environment, you keep ownership and grant us a license to host and process it to provide the Site. If you send feedback or ideas, we may use them without restriction, attribution, or payment.

Privacy and links

Our Privacy policy explains what we collect and why. We are not responsible for third-party sites we link to.

Disclaimer

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SITE WILL BE ACCURATE, COMPLETE, UNINTERRUPTED, OR ERROR FREE. NOTHING ON THE SITE IS LEGAL, FINANCIAL, MEDICAL, OR INVESTMENT ADVICE.

Liability and indemnity

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY ARISING FROM THE SITE IS LIMITED TO ONE HUNDRED DOLLARS ($100) OR, IF YOU HAVE PAID US FOR SITE ACCESS IN THE PRIOR TWELVE MONTHS, THE AMOUNT YOU PAID.

This does not limit liability that cannot be limited by law and does not apply to a signed agreement with its own cap. You will defend and indemnify us against claims arising from your use of the Site in breach of these terms or of law.

Termination and changes

We may suspend or end access at any time. The sections on simulation output, your content, disclaimer, limitation of liability, indemnity, and general terms survive. We may update these terms, change the effective date above, and notify customers of material platform-term changes under their agreements.

General and contact

Delaware law governs, without its conflict rules. Disputes go exclusively to the state or federal courts in Delaware, and both sides waive trial by jury. We may assign these terms to a successor; you may not assign them. If a term is unenforceable it is narrowed rather than struck. These terms, the Acceptable use policy, and the Privacy policy are the entire agreement about the Site.
